        2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
        3. attempt to decompile or reverse engineer any software contained on KAI's web site;
        4. remove any copyright or other proprietary notations from the materials; or
        5. transfer the materials to another person or "mirror" the materials on any other server.
      2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by KAI at any time. 3. Disclaimer

      The materials on KAI's web site are provided “as is." Further, KAI and its affiliated organizations do not warrant or make any representations concerning the accuracy, likely results, completeness or reliability of any opinions, advice, services, merchandise or other information or use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

    4. Limitations

      Neither KAI or any affiliated organization shall be responsible for information provided herein under any theory of liability or indemnity. The user agrees to hold harmless and indemnify KAI, all affiliated organizations, employees and partners from any and all claims brought against KAI, all affiliated organizations, employees and partners arising from the User’s use. User’s obligation to defend, hold harmless and indemnify KAI, all affiliated organizations, employees and partners shall extend to claims alleging acts of negligence, fault, and direct or contributory infringement on the part of KAI, all affiliated organizations, employees and partners.

      The parties specifically intend that the provisions of this section shall apply even if such provisions act to exculpate KAI, all affiliated organizations, employees and partners from its own conduct, including negligence.

      To the maximum extent permitted by applicable law, in no event shall we be liability for any direct, special, incidental, or consequential damages whatsoever (including, without limitation, damages for loss of data or profit, or due to business interruption, or any other pecuniary loss) arising out of or in any way connected with the use of materials on KAI’s internet site or for the use or performance of this internet site, the provision of or failure to provide services, or for any information or services, even if KAI or a KAI authorized representative has been notified oraly or in writing of the possibility of such damages.

      Because some states and jurisdictions do not allow the exclusion or limitation of liability, the above limitation may not apply to you.

      If any of the provisions of this Agreement are held by a court or other tribunal of competent jurisdiction not to be enforceable, then such provisions shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.
